TERMS OF USE

Without prejudice to a more specific written agreement, all the conditions currently listed apply to all products and to all buyers - customers and any transaction regarding purchases from the konstas-market.gr online store and falls under the conditions stated below and are clearly stated in our online store.

Personal Data Protection Regulation

Our store has fully adapted to the GDPR framework and personal data is processed in accordance with the provisions of the General Data Protection Regulation (GDPR 2016/679), as well as for the protection of personal data and privacy in the electronic sector communications (Law 3471/2006) and the decisions of the Personal Data Protection Authority (PDPA).

OFFER AND CONCLUSION OF AGREEMENT

All products are determined in terms of weight, colors, accessories and technical characteristics by the respective Manufacturing Company. Some product photos are samples and the color of the final product may vary.

Orders are placed by the Sales Department of konstas-market.gr, which is responsible for the availability and shipping of the products.

The buyer must be informed about the technical characteristics of the products he orders. Any update on our part, regarding technical or other information, is done with every reservation.

Shipping of orders, as long as the product is available, is done on the same day and its delivery depends on the mileage, or the mediation of weekends or holidays. If in case it is not available the delivery to the courier is postponed up to three working days. The consumer has the right to withdraw within fourteen (14) calendar days, if no longer period has been agreed, but returning the goods in their excellent original condition and packaging, without incurring any costs, except for the return costs.

In case of non-execution of the order as agreed, the customer has every right to cancel it.

In the event that the product is no longer available and cannot be delivered within a reasonable period of time, the sales department of konstas-market.gr informs the customer and cancels the order after a written (e-mail) or telephone notification or suggests the ideal alternative solution.

The prices of all products are clearly indicated next to each product and include VAT. The shipping cost is automatically adjusted and appears in full in the shopping cart in cases of accessible or remote areas, you will be informed in time of any additional charges

SHIPPING / TRANSPORTATION

Goods travel at the cost and responsibility of the customer.

For transfers delayed by external factors (such as strikes, road closures, extreme weather, etc.) our store bears no responsibility.

DANGERS

Once the goods are checked and received by the buyer, the store is released from any further responsibility.

OBLIGATIONS AND WARRANTIES

Matters of guaranteeing the goods and any returns for any reason are determined by the provisions of the Greek Laws and the provisions of the Directives of the European Union.

The respective manufacturer is solely responsible for any warranty provision (including the manner in which it is performed). We are obliged to follow faithfully and without exception all standard and prescribed inspection, repair or return procedures established by him.

Solely responsible for any diagnosis and opinion of a problem in the devices are the official Technical control and repair centers of the manufacturers and they are not disputed.

Greek and European Legislation ensures the rights of consumers with Laws and Directives such as N2251/94 (Government Gazette 191/16-11-1994), AK §534, §537, §540 and §554, §555 as amended by N3043/ 2002.

The Manufacturer's Warranty only covers manufacturing errors or defects in the device. Any damage resulting from dropping, moisture, negligence, mishandling, tampering with the internal parts by unauthorized persons or improper use, automatically places the product "Out of Warranty" and its repair will be charged.

    konstas-market.gr undertakes that all personal information submitted to it (Name, Address, Telephones, E-mail address, etc.) is registered (accessible) by authorized employees, strictly and only when required, such as for the processing of orders, while they are not subject to management, notification to third parties and are not used for other purposes (e.g. advertising). Cases of prosecutorial, judicial or other public authority decisions are excluded from this.

    Any transaction through Cards indicates prior full understanding of the terms of use and system operation. For more information about the security of your transactions or if you have any doubts, please, before submitting your transaction, contact us directly by e-mail, asking us related questions (you can also contact the Bank's Customer Service Department ). It is possible to pay by credit, debit and prepaid cards (except AMEX and Diners).

ATTENTION: There is no additional charge for using Credit and Debit Cards. Given that the submission of your credit/debit card information is done via computer (remotely) and not with your physical presence in our store, it is possible that there will be a relative delay by the Bank until the approval is completed, with the consequence that the shipping the goods to you. During this time, although the money will have already been reserved from your account, in no case will it have been reserved by us or for our benefit but by the Bank itself (until the completion or termination of the transaction).

RESERVATIONS

Konstas-market.gr cannot be blamed for any damage that may be caused by the products it sells and markets and which are covered by European safety rules. Each manufacturer must inform in the enclosed instructions about the correct way of use and the precautions of their products.

software

The software that is present in the devices has the usage license given by the manufacturer of the software. The terms of use, instructions and limitations of use are likewise given by the manufacturer of the software and not of the product. Software packages or products containing software can only be returned if the manufacturer's Security Tape has not been opened and the package must be in perfect condition.

LEGAL RIGHTS

For any transaction made with konstas-market.gr, the Legislation of Greece applies and it is agreed that the competent authorities for the resolution of disputes are the Courts of Athens.

WARRANTIES & SERVICE

Product photos are samples and the color of the final product may vary. Returns or replacements of products (e.g. due to color) are accepted only after consultation and as long as the product has not been opened or used.

Non-returnable products:

For hygiene reasons, the following products are not returned (unless they are defective):

a) Underwear

b) Swimwear

c) Cosmetics

d) Socks/Tights

e) Jewelry

Products from which the necessary protectors, labels and tags of the supplier/manufacturer have been removed

Beauty products such as perfumes, cosmetics and personal care products if their packaging or outer plastic cover/film is damaged or worn. Also, returns are not accepted in cases of wear or damage to its packaging.

Products must be returned:

a) unused, in their original packaging – box and cellophane – and in excellent condition

b) with all labels up

c) in exactly the same condition in which they were received, intact, sealed and without any damage

A necessary condition for the return of products is that you have in your possession the relevant purchase document that proves the transaction (e.g. Retail Receipt or Sales Invoice).

The cost of Transportation, of all products returned to the Company, is borne by the buyer.

konstas-market.gr reserves the right not to accept product returns when it deems that there are special reasons.

DOA/DAP

konstas-market.gr provides consumers with the assurance of replacement of any defective device purchased from us, when certain conditions are met.

CONDITIONS: If you have purchased a device which due to a manufacturing fault could not be put into operation in the first place, it is automatically marked as DOA i.e. "Dead On Arrival", which means that the device never worked. If you bought a device that was put into operation but then in the next few days showed symptoms of a serious malfunction, then the device is automatically classified as DAP i.e. "Dead After Purchase" which means that the device stopped working or had serious problems (or actual defects) within a reasonable interval defined (or suggested) by the manufacturer. In the case of DAP, the replacement or repair of the device is defined exclusively by the manufacturer's service policy.

 

PROCEDURES: The certified procedures we follow as a store are in harmony with the official procedures followed by the manufacturers and official points of sale worldwide. So if you buy from us a device that unfortunately falls under the above mentioned then you should first of all inform us by phone or send us an email message so that we can register the problem and direct you to be on time (calendar) in how to provide it of the special limited Warranty.

Also for your own better service you should seriously consider the following: Please, first of all, be informed about the power range of this special provision (DAP/DOA) of the device you are interested in. Each Manufacturer defines (or suggests) a different calendar time period and it may differ from Company to Company. Usually this period includes only a few days or maximum time of using the device. All the standard procedures we follow for (DAP/DOA) apply to all consumers without exception and without exception. Under no circumstances do we have the right to arbitrarily or act discriminatory or selective towards a portion of consumers contrary to the instructions or in violation of the terms of the respective manufacturer. Any decision regarding whether or not a specific device is covered by the warranty (DAP/DOA) is made by the official technical department of the respective Manufacturer in our Country. In no case is it recognized (DAP/DOA) if there is no corresponding official written reminder from the technical department. And the time period required for this control depends solely on them, taking into account (and based on the Law) the minimum possible inconvenience to the consumer and for any delay in this, konstas-market.gr bears absolutely no responsibility responsibility.

Konstas-market.gr under no circumstances replaces a product with a similar or different one or returns money to any consumer if the relevant control is not first carried out and if there is no written proof from the manufacturer (via the mouth of the respective technical department) that it is in force the DAP/DOA. Any objections, objections, disagreements on behalf of the consumer should be communicated primarily to us and by extension to the competent technical control department as well as to the competent Department of Consumer Protection of the Ministry of Development.

EXCEPTIONS

The DAP/DOA special limited warranty does not apply if:

The damage is proven to be the fault of the consumer with an official document from the official technical department of the manufacturer (regarding the warranty regarding the fault of the consumer, you can refer to the general warranty conditions of our store).

The device does not come with the box and all its accessories (eg battery, booklet, hands free, charger, etc.). The period of validity of the Warranty, which is proven between the comparison of the receipt (or invoice) of purchase and the document of receipt from our store for inspection, shall be calculated on a calendar basis.

If your device has not been purchased from our store or if the IF number or the unique IMEI number clearly written on the purchase document is not the same as that of the device you will present to us.

If for any reason you have additional questions regarding the terms or methods of providing the DAP/DOA warranty, please contact us so that we can inform you about it. In any case, we promise that with responsibility and seriousness, we provide you with high-level products and services, according to the strictest specifications and quality controls of the global market.

CLARIFICATIONS

By confirming each order electronically, it is understood that all terms are fully understood and unconditionally accepted. Any question, clarification or unclear understanding of the shipping, payment and warranty terms, which are currently stated, should be clarified by the buyer, requesting further details in writing. In case of any dispute, the recipient is obliged to notify konstas-market.gr in writing within 48 hours of receipt, indicating the notification by registered letter or to submit it electronically by requesting proof of receipt. In this case, the customer is obliged to immediately return all goods intact and konstas-market.gr expressly reserves the right to withdraw from this sale free of charge. In any case, konstas-market.gr is committed, that it will do its best to ensure you a reliable and profitable market from every point of view.
